11. An offence under section 128 of the Mental Health Act 1959(1) (sexual intercourse with patients) if it was committed in relation to a person under the age of 16.

1959 c. 72; section 128 was amended by section 129 of and paragraph 29 of Schedule 15 and Schedule 16 to the National Health Service Act 1977 (c. 49); section 148 of and paragraph 15 of Schedule 3 to the Mental Health Act 1983 (c. 20); and section 57 of and paragraph 2 of Schedule 1 to the Registered Homes Act 1984 (c. 23) and section 116 of and paragraph 2 of Schedule 4 to the Care Standards Act 2000 (c. 14).
