Office of Communications Act 2002 (Commencement No. 3) and Communications Act 2003 (Commencement No. 2) (Amendment) Order 2004

The Secretary of State, in exercise of the powers conferred upon her by section 411(2) of the Communications Act 2003(1), hereby makes the following Order:

Citation

1.  This Order may be cited as the Office of Communications Act 2002 (Commencement No. 3) and Communications Act 2003 (Commencement No. 2) (Amendment) Order 2004.

Amendment of the previous commencement order

2.—(1) The Office of Communications Act 2002 (Commencement No. 3) and Communications Act 2003 (Commencement No. 2) Order 2003(2) is amended as follows.

(2) At the end of article 4 insert—

(4) The following provisions of the principal Act shall come into force on 1st July 2004—

(a)section 278;

(b)sections 351 and 353 (so far as not already in force); and

(c)paragraph 8 of Schedule 12.

(3) In Schedule 2—

(a)for “Sections 2, 351 and 353”, substitute “Section 2”;

(b)omit the words “278 and”; and

(c)omit the entry for paragraph 8 of Schedule 12.

Explanatory Note

(This note is not part of the Order)

This Order amends the Office of Communications Act 2002 (Commencement No. 3) and Communications Act 2003 (Commencement No. 2) Order 2003.

By virtue of article 4(2) of and Schedule 2 to that Order, section 278, sections 351 and 353 (so far as not already in force) and paragraph 8 of Schedule 12 to the Communications Act 2003 were due to come into force on 1st April 2004. Article 2 of this Order substitutes a new date of 1st July 2004 for the coming into force of these provisions.
