The Water Act 2003 (Commencement No. 1 and Transitional Provisions) Order 2004

The Secretary of State, in exercise of the powers conferred upon her by sections 104(6)(a) and 105(3) to (6) of the Water Act 2003(1) and having consulted the National Assembly for Wales(2), hereby makes the following Order:

The power in section 105(3) to appoint a day on which provisions of the Water Act 2003 shall come into force is vested in the “appropriate authority”. The appropriate authority in relation to provisions of the Act for which a day is appointed by this Order (except sections 69 and 75) is the Secretary of State after consulting “the Assembly” (the National Assembly for Wales: section 105(2)); the appropriate authority in relation to sections 69 and 75 is the Secretary of State in relation to England and the Assembly in relation to Wales (section 105(5) and (6)).
