The Secretary of State makes the following Order in exercise of the powers conferred by section 27 of the Further and Higher Education Act 1992(1) (“the Act”).
In accordance with section 51 of the Act, she has received a proposal for the dissolution of the further education corporation known as The People’s College, Nottingham, (2) (“the corporation”) from the Learning and Skills Council for England.
In accordance with section 27(7)(a) of the Act she has consulted the corporation. In accordance with section 27(2), the Order is made with the consent of the further education corporation known as Broxtowe College, Nottingham (3) (“Broxtowe College”).
1. This Order may be cited as the People’s College, Nottingham (Dissolution) Order 2006 and shall come into force on 1st June 2006.
2. On 1st June 2006 the corporation shall be dissolved and all of its property, rights and liabilities shall be transferred to Broxtowe College, being a body corporate established for purposes which include the provision of educational facilities or services.
3. Section 26(2), (3) and (4) of the Act shall apply to any person employed by the corporation immediately before 1st June 2006 as if the references in that section—
(a)to a person to whom that section applies were to a person so employed;
(b)to the operative date were to 1st June 2006;
(c)to the transferor were to the corporation; and
(d)to the corporation were to Broxtowe College.

This Order dissolves with effect from 1st June 2006 the further education corporation established to conduct The People’s College, Nottingham. It provides for the transfer of its property, rights and liabilities to Broxtowe College, Nottingham and secures the rights of its employees by applying section 26(2) to (4) of the Further and Higher Education Act 1992.
Established by the Education (Further Education Corporations) Order 1992 (S.I. 1992/2097) under the name of The People’s College of Tertiary Education, Nottingham; and was renamed The People’s College, Nottingham on 2nd April 1996.
