The Secretary of State for Health makes the following Regulations in exercise of the powers conferred on her by sections 79 and 126(4) of the National Health Service Act 1977(1).

Citation, commencement and application

1.—(1) These Regulations may be cited as the National Health Service (Dental Charges) Amendment Regulations 2006 and shall come into force on 10th August 2006.

(2) These Regulations apply in relation to England only(2).

Amendment to the National Health Service (Dental Charges) Regulations 2005

2.  In Schedule 3 to the National Health Service (Dental Charges) Regulations 2005(3) (Band 3 Charges – Provision of Appliances) paragraph (i) shall be omitted.

Explanatory Note

(This note is not part of the Regulations)

These Regulations correct an error in the National Health Service (Dental Charges) Regulations 2005 (S.I. 2005/3477) (“the 2005 Regulations”).

Regulation 2 removes the reference to “Crowns in other materials” in the list of appliances for which a Band 3 charge may be made and recovered in Schedule 3 to the 2005 Regulations.

A full Regulatory Impact Assessment of the effect has been prepared in respect of the 2005 Regulations. A copy of the Regulatory Impact Assessment can be obtained from www.dh.gov.uk/ria.

1977 c. 49. Section 79 was substituted by section 183 of the Health and Social Care (Community Health and Standards) Act 2003 (c. 43). Section 126(4) was amended by section 65(2) of the National Health Service and Community Care Act 1990 (c. 19) (“the 1990 Act”), section 65(1) of, and paragraphs 4 and 37 of Schedule 4 to, the Health Act 1999 (c. 8), section 67(1) of, and paragraphs 5 and 13 of Part 1 of Schedule 5 to, the Health and Social Care Act 2001 (c. 15), and section 6(3)(c) and 37(1) of the National Health Service Reform and Health Care Professions Act 2002 (c. 17). See also section 128(1) of the National Health Service Act 1977, as amended by section 26(2)(g) and (i) of the 1990 Act for the meaning of “prescribed” and “regulations”.

The functions of the Secretary of State under section 79 of the National Health Service Act 1977 were transferred to Wales by article 2(a) of the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I.1999/672), as amended by section 66(5) of the Health Act 1999.
