The Secretary of State makes the following Order in exercise of the powers conferred by sections 29(1)(d), (4) and 60(5) of the National Lottery etc. Act 1993(1).
1. This Order may be cited as the National Lottery etc. Act 1993 (Amendment of Section 23) Order 2006 and shall come into force on 1st April 2006.
2.—(1) Section 23(2) of the National Lottery etc. Act 1993 (sums paid into the Distribution Fund and allocated for expenditure on or connected with sport to be held for distribution by certain bodies)(2) is amended as follows.
(2) In paragraph (a) (proportion of such sums so allocated to be held for distribution by the English Sports Council), for “75.6 per cent” substitute “62 per cent”.
(3) In paragraph (e) (proportion of such sums so allocated to be held for distribution by the United Kingdom Sports Council), for “9.2 per cent” substitute “22.8” per cent”.
3. The sum of £7,000,000, being a sum that apart from this Order would be held in the National Lottery Distribution Fund for distribution by the English Sports Council, shall be held in that Fund for distribution by the United Kingdom Sports Council.

Section 23 of the National Lottery etc. Act 1993 specifies the bodies that are to distribute sums paid into the National Lottery Distribution Fund. Subsection (2) deals with sums paid into that Fund and allocated for expenditure on or connected with sport.
This Order increases the percentage held for the United Kingdom Sports Council (known as UK Sport) from 9.2% to 22.8% and makes a corresponding decrease in the percentage held for the English Sports Council (known as Sport England). This Order also transfers £7 million from the amount held in the National Lottery Distribution Fund for distribution by Sport England to be held for distribution by UK Sport.
