The Secretary of State has been designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to greenhouse gas emission allowance trading.
She makes the following Regulations in exercise of the powers conferred upon her by that subsection and by section 2(1) of the Pollution Prevention and Control Act 1999(3) (the “1999 Act”).
In accordance with section 2(4) of the 1999 Act she has consulted the Environment Agency, the Scottish Environment Protection Agency, such bodies or persons appearing to her to be representative of the interests of local government, industry, agriculture and small businesses respectively and such other bodies and persons as she considers appropriate.
1972 c. 68. Section 57(1) of the Scotland Act 1998 (c. 46) provides that despite the transfer to the Scottish Ministers of functions in relation to observing and implementing obligations under Community law by virtue of that Act, any function of a Minister of the Crown shall continue to be exercisable by him as regards Scotland for the purposes specified in section 2(2) of the European Communities Act 1972.
1999 c. 24. By virtue of Article 3(1) of the National Assembly for Wales (Transfer of Functions) Order 2005 (S.I. 2005/1958), the functions of the Secretary of State under section 2 of this Act were transferred to the National Assembly for Wales so far as they are exercisable in relation to Wales except in relation to offshore oil and gas exploration and exploitation. Regulation 11 of these regulations is the only part of these regulations made under that power, and relates solely to installations for the offshore exploration and exploitation of oil and gas.
