The Secretary of State for Work and Pensions makes the following Regulations in exercise of the powers conferred by sections 37(3)(a), (b) and (g), (4), (5) and (8), 76(2), (3)(d) and (8), 124(1), 125(3) and 174(2) and (3) of the Pensions Act 1995(1) and sections 251(6)(a) and 318(1) of the Pensions Act 2004(2).

In accordance with section 120(1) of the Pensions Act 1995 and section 317(1) of the Pensions Act 2004 the Secretary of State for Work and Pensions has consulted such persons as he considers appropriate.

1995 c. 26. Section 37 was substituted by section 250 of the Pensions Act 2004 (c. 35). Section 76 was amended by paragraphs 34 and 62 of Schedule 12 and Schedule 13 to the Pensions Act 2004. Section 124(1) is cited for the meaning there given to “prescribed” and “regulations”.
