In exercise of the powers conferred by section 153(4) of the Environmental Protection Act 1990(1), the Secretary of State makes the following Order.

Citation and commencement

1.  This Order—

(a)may be cited as the Financial Assistance for Environmental Purposes Order 2007; and

(b)comes into force on 9th July 2007.

Extent

2.  This Order extends to England and Wales and Northern Ireland, except for article 3(a) which extends to England and Wales only.

Variation of section 153(1) of the Environmental Protection Act 1990

3.  In section 153(1)(2) of the Environmental Protection Act 1990 (purposes for which financial assistance may be given)—

(a)for paragraph (uu), substitute—

(uu)the International Sustainable Development Fund;; and

(b)omit paragraph (ww).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order varies section 153(1) of the Environmental Protection Act 1990 (c. 43) in two respects. First, this Order replaces paragraph (uu) of that section with a new paragraph which enables the Secretary of State, with the consent of the Treasury, to give financial assistance to, or for the purposes of, the International Sustainable Development Fund (“ISDF”). Paragraph (uu) formerly related to the scheme known as the UK Environment for Europe Fund. Secondly, this Order omits paragraph (ww), which related to the scheme known as the World Summit on Sustainable Development Implementation Fund.

The purpose of the ISDF is to rationalise and consolidate financial support for projects and activities promoting the United Kingdom’s commitments for action on sustainable development at international level by merging the UK Environment for Europe Fund and the World Summit on Sustainable Development Implementation Fund.

A Regulatory Impact Assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.

The relevant functions of the Secretary of State insofar as they are exercisable within the devolved competence were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46). In relation to Wales, the Secretary of State has concurrent powers with the Welsh Ministers: see article 2 of, and the entry relating to the Environmental Protection Act 1990 in Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) and paragraphs 30 to 32 of Schedule 11 to the Government of Wales Act 2006 (c. 32).
