In exercise of the powers conferred on the Secretary of State by sections 19 and 42(6) of the Teaching and Higher Education Act 1998 M1 and sections 132, 134 and 210(7) of the Education Act 2002 M2 , the Secretary of State for Children, Schools and Families makes the following Regulations:

Citation, commencement and application E+W

1.  These Regulations may be cited as the Education (Recognition of School Teachers' Professional Qualifications) (Consequential Provisions) (England) Regulations 2007 and come into force on 19th October 2007.

2.  These Regulations apply in relation to England.

Amendment to the Education (Induction Arrangements for School Teachers) (Consolidation) (England) Regulations 2001 E+W

3.  For paragraph 9 of Schedule 2 to the Education (Induction Arrangements for School Teachers) (Consolidation) (England) (Regulations) 2001 M3 substitute—

“9.   The person is a person who is, as respects the profession of school teacher, entitled to practice pursuant to Part 2 and Chapters 1, 2 and 4 of Part 3 of the European Communities (Recognition of Professional Qualifications) Regulations 2007 M4 .”.

Amendment to the Education (School Teachers' Qualifications) (England) Regulations 2003 E+W

4.  For paragraph 8 of Schedule 2 to the Education (School Teachers' Qualifications) (England) Regulations 2003 M5 , substitute—

“8.   The person is a person who is, as respects the profession of school teacher, entitled to practice pursuant to Part 2 and Chapters 1, 2 and 4 of Part 3 of the European Communities (Recognition of Professional Qualifications) Regulations 2007.”.

Amendment to the Education (Specified Work and Registration) (England) Regulations 2003 E+W

5.  After paragraph 2 of Schedule 3 to the Education (Specified Work and Registration) (England) Regulations 2003 M6 insert—

“3.   A teacher who is a qualified teacher by virtue of regulation 5 of, and paragraph 8 of Schedule 2 to, the 2003 Qualifications Regulations is excepted from the requirement to be registered under regulation 7 if he only carries out specified work in a school on a temporary or occasional basis as determined in accordance with regulation 9(2) of the European Communities (Recognition of Professional Qualifications) Regulations 2007.”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations substitute references to the European Communities (Recognition of Professional Qualifications) Regulations 2007 (S.I. 2007/2781)) (the 2007 Regulations) for references to Council Directive 89/48/EEC in the Education (Induction Arrangements for School Teachers) (Consolidation) (England) Regulations 2001 (S.I. 2001/2897, as amended by S.I. 2003/106) and the Education (School Teachers' Qualifications) (England) Regulations 2003 (S.I. 2003/1662) (regulations 3 and 4).

They also amend the Education (Specified Work and Registration) (England) Regulations 2003 (S.I. 2003/1663, as amended by S.I. 2007/2117) to exempt qualified teachers who, as respects the profession of school teacher, fall within the 2007 Regulations from the requirement to be registered with full registration with the General Teaching Council for England if they only carry out specified work in a school on a temporary or occasional basis (regulation 5).

The 2007 Regulations implement Directive 2005/36/EC of the European Parliament and of the Council on the recognition of professional qualifications. That Directive replaces and combines into a single text Council Directives 89/48/EEC and 92/51/EEC and Directive 1999/42/EC of the European Parliament and of the Council on the general system for the recognition of professional qualifications and twelve related Council Directives concerning particular professions.

A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
