The Secretary of State makes the following Regulations in exercise of the powers conferred on him by section 2(2) of the European Communities Act 1972 M1.
The Secretary of State has been designated for the purposes of that section in relation to the control and regulation of genetically modified organisms M2.
There has been open and transparent consultation during the preparation of these Regulations in accordance with the requirements of Article 9 of Regulation (EC) No. 178/2002 of the European Parliament and of the Council M3 laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety.

1. These Regulations may be cited as the Feed (Corn Gluten Feed and Brewers Grains) (Emergency Control) (England) (Revocation) Regulations 2007 and come into force on 30th November 2007.
2. The Feed (Corn Gluten Feed and Brewers Grains) (Emergency Control) (England) Regulations 2005 M4 are revoked.

3.—(1) Regulation 8 (inspection, seizure and detention of suspected animal feed) of the Genetically Modified Animal Feed (England) Regulations 2004 M5 is amended in accordance with paragraphs (2) and (3).
(2) In paragraph (5) the expression “ Subject to paragraph (6) ” is substituted for the expression “Subject to paragraphs (5A), (5B) and (6)”.
(3) Paragraphs (5A) and (5B) are omitted.

4. In Schedule 2 (definition of relevant feed law) of the Official Feed and Food Controls (England) Regulations 2006 M6, paragraph (f) is omitted.

These Regulations revoke the Feed (Corn Gluten Feed and Brewers Grains) (Emergency Control) (England) Regulations 2005 (S.I.2005/1265), and make consequential amendments to the Genetically Modified Animal Feed (England) Regulations 2004 (S.I. 2004/2334) and the Official Feed and Food Controls (England) Regulations 2006 (S.I. 2006/15).U.K.
2. The Regulations implement Commission Decision 2007/157/EC repealing Decision 2005/317/EC on emergency measures regarding the non-authorised genetically modified organism Bt 10 in maize products (OJ No. L68, 8.3.2007, p.8).U.K.
3. A full regulatory assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.U.K.
