The Secretary of State is designated for the purposes of section 2(2) of the European Communities Act 1972 M1 in relation to the common agricultural policy of the European Community M2.
These Regulations make provision for a purpose mentioned in that section and it appears to the Secretary of State that it is expedient for the references to the Community instruments mentioned in regulation 2 to be construed as references to those instruments as amended from time to time.
The Secretary of State makes the following Regulations under the powers conferred by section 2(2) of, and paragraph 1A of Schedule 2 to, the European Communities Act 1972 M3:

M3Paragraph 1A of Schedule 2 was inserted by section 28 of the Legislative and Regulatory Reform Act 2006 (c. 51).
1. These Regulations may be cited as the Common Agricultural Policy Single Payment Scheme (Set-aside) (England) (Amendment) Regulations 2007 and come into force on 31st March 2007.
2.—(1) The Common Agricultural Policy Single Payment Scheme (Set-aside) (England) Regulations 2004 M4 are amended as follows.
(2) In regulation 2—
(a)for the definition of “Commission Regulation 795/2004” in paragraph (1), substitute—
““Commission Regulation 795/2004” means Commission Regulation (EC) No 795/2004 laying down detailed rules for the implementation of the single payment scheme provided for in Council Regulation (EC) No 1782/2003 establishing common rules for direct support schemes under the common agricultural policy and establishing certain support schemes for farmers, as amended from time to time;”M5;
(b)for the definition of “Commission Regulation 1973/2004” in paragraph (1), substitute—
““Commission Regulation 1973/2004” means Commission Regulation (EC) No 1973/2004 laying down detailed rules for the application of Council Regulation (EC) No 1782/2003 as regards the support schemes provided for in Titles IV and IVa of that Regulation and the use of land set aside for the production of raw materials, as amended from time to time;”M6;
(c)for the definition of “the Council Regulation” in paragraph (1), substitute—
““the Council Regulation” means Council Regulation (EC) No 1782/2003 establishing common rules for direct support schemes under the common agricultural policy and establishing certain support schemes for farmers and amending Regulations (EEC) No 2019/93, (EC) No 1452/2001, (EC) No 1453/2001, (EC) No 1454/2001, (EC) 1868/94, (EC) No 1251/1999, (EC) No 1254/1999, (EC) No 1673/2000, (EEC) No 2358/71 and (EC) No 2529/2001, as amended from time to time;”M7; and
(d)omit paragraph (2).
(3) In regulation 4, omit paragraph (4).
(4) In paragraph 13(3) of Schedule 1—
(a)for the definition of “Compendium of UK Organic Standards”, substitute—
““Compendium of UK Organic Standards” means the Compendium of UK Organic Standards, September 2006 Edition published by the Department for Environment, Food and Rural Affairs;”;
(b)for the definition of “Council Regulation (EEC) No 2092/1991”, substitute—
““Council Regulation (EEC) No 2092/91” means Council Regulation (EEC) No 2092/91 on organic production of agricultural products and indications referring thereto on agricultural products and foodstuffs, as amended from time to time;”M8;
(c)in the definition of “Organic land”, for “Council Regulation (EEC) No 2092/1991” both times it appears, substitute “ Council Regulation (EEC) No 2092/91 ”.

These Regulations amend the Common Agricultural Policy Single Payment Scheme (Set-aside) (England) Regulations 2004 (S.I. 2004/3385) to incorporate amendments to Community legislation, provide for the incorporation of future amendments to that Community legislation in national law and to update the reference to the Compendium of Compendium of UK Organic Standards so as to refer to the most recent edition.
A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
