The Secretary of State makes the following Order in exercise of the powers conferred by sections 29 and 60(5) of the National Lottery etc. Act 1993(1).
1. This Order may be cited as the National Lottery etc. Act 1993 (Amendment of Section 23) Order 2007 and shall come into force on 1st April 2007.
2.—(1) Section 23(1) of the National Lottery etc. Act 1993 (sums paid into the Distribution Fund and allocated for expenditure on or connected with the arts to be held for distribution by certain bodies)(2) is amended as follows.
(2) In paragraph (a)(3) (proportion of such sums so allocated to be held for distribution by the Arts Council of England), for “71.1 per cent” substitute “69.78 per cent”.
(3) In paragraph (e)(4) (proportion of such sums so allocated to be held for distribution by the Film Council)—
(a)for “12.2 per cent” substitute “13.52 per cent”,
(b)for “Film Council” substitute “UK Film Council”.

Section 23 of the National Lottery etc. Act 1993 specifies the bodies that are to distribute sums paid into the National Lottery Distribution Fund. Subsection (1) deals with sums paid into that Fund and allocated for expenditure on or connected with the arts. This Order increases the percentage held for distribution by the UK Film Council from 12.2% to 13.52% and makes a corresponding decrease in the percentage held for distribution the Arts Council of England. The UK Film Council is the body with the primary responsibility for awarding grants from National Lottery proceeds in respect of films and film-making and is a company limited by guarantee registered in England and Wales (registered number 3815052). This Order also updates the name of the UK Film Council to reflect the change of the name of that company.
