The Secretary of State for Health, in exercise of the powers conferred by section 170(3) and (4) of the Health and Social Care Act 2008(1), makes the following Order:
1. This Order may be cited as the Health and Social Care Act 2008 (Commencement No.1) Order 2008.
2. 25th August 2008 is the day appointed for the coming into force of the following provisions of the Health and Social Care Act 2008—
(a)section 127 (which gives effect to Schedule 10) in so far as it gives effect to the provisions referred to in paragraphs (b) and (c);
(b)paragraph 20 of Schedule 10 (amendments to the Health Act 2006 relating to directions given by the Secretary of State to the Appointments Commission); and
(c)paragraph 21 of Schedule 10 in so far as it relates to section 60(3)(a) of the Health Act 2006 (amendments relating to directions given by the Privy Council to the Appointments Commission).

This Order brings into force specified provisions of the Health and Social Care Act 2008 relating to the Appointments Commission. The provisions listed in Article 2, which relate to the power to give directions to the Appointments Commission, are brought into force on 25th August 2008. These provisions include new powers to make directions in respect of the chair and certain non-executive members of the Council for Healthcare Regulatory Excellence.
