The Secretary of State makes the following Order in exercise of the powers conferred by sections 28(1), (2) and (4), 272(7) and 273(1) of the National Health Service Act 2006(1):
1.—(1) This Order may be cited as the NHS Professionals Special Health Authority (Establishment and Constitution) (Amendment) Order 2008 and shall come into force on 1st April 2008.
(2) This Order applies to England only.
2. For article 4 of the NHS Professionals Special Health Authority (Establishment and Constitution) Order 2003(2) (constitution of the Authority) substitute the following article—
“4.—(1) The Authority shall consist of—
(a)a chairman;
(b)either 4 or 5 members who are not officers of the Authority;
(c)the persons who for the time being hold the office of Chief Executive and Director of Finance of the Authority; and
(d)either 2 or 3 other officers of the Authority.
(2) An officer of the Authority, other than the Chief Executive or Director of Finance, shall not be appointed as a member of the Authority if the number of members who are officers of the Authority would exceed the number of members, other than the chairman, who are not officers of the Authority.”.

This Order amends the NHS Professionals Special Health Authority (Establishment and Constitution) Order 2003, which provides for the establishment and constitution of a Special Health Authority, to be known as NHS Professionals Special Health Authority (“the Authority”). This Order changes the numbers of officer and non-officer members of the Authority.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
