The Secretary of State makes the following Order in exercise of the powers conferred by section 153(4) of the Environmental Protection Act 1990(1).

Citation, extent and commencementE+W

1.  This Order—

(a)may be cited as the Financial Assistance for Environmental Purposes (England and Wales) Order 2009;

(b)extends to England and Wales only; and

(c)comes into force on 15th July 2009.

Variation of section 153(1) of the Environmental Protection Act 1990E+W

2.  In section 153(1) of the Environmental Protection Act 1990(2) (purposes for which financial assistance may be given), after paragraph (zz), add—

(aaa)the Low Carbon Vehicle Partnership Limited, in relation to its activities as respects England and Wales.

EXPLANATORY NOTE

(This note is not part of the Order.)

This Order varies section 153(1) of the Environmental Protection Act 1990 so as to enable the Secretary of State, with the consent of the Treasury, to give financial assistance to, or for the purposes of, the Low Carbon Vehicle Partnership Limited in relation to its activities in England and Wales.

The Low Carbon Vehicle Partnership Limited is a company limited by guarantee whose main objects are the preservation, conservation and protection of the environment by the reduction of greenhouse gas emissions from road transport through encouraging a shift to low carbon vehicles and fuels and their efficient use.

An Impact Assessment has not been produced for this instrument as no impact on the costs of business, the public sector, third party sector organisations, regulators or consumers is foreseen.

The relevant functions of the Secretary of State insofar as they are exercisable within the devolved competence were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46). In relation to Wales, the Secretary of State has concurrent powers with Welsh Ministers: see article 2 of, and the entry relating to the Environmental Protection Act 1990 in Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) and paragraphs 30 to 32 of Schedule 11 to the Government of Wales Act 2006 (c.32). The relevant functions of the Secretary of State in relation to transferred matters are exercisable by Northern Ireland Ministers and departments by virtue of section 23 of the Northern Ireland Act 1998 (c.47).
