EXPLANATORY NOTE

(This note is not part of the Regulations)

These regulations amend the School Organisation (Establishment and Discontinuance of Schools)(England) Regulations 2007. They replace references to the “APA” (that is the Annual Performance Assessment) rating with references to a performance rating. These amendments reflect new arrangements whereby the annual performance rating of local authorities made by Her Majesty’s Chief Inspector of Education, Children’s Services and Skills under section 138(3) of the Education and Inspections Act 2006 will no longer be known as an APA but will be an element of a new Comprehensive Area Assessment.

(1)

2006 c. 40; see section 32(1) for the definitions of “prescribed” and “regulations”.

(2)

S.I. 2007/1288; a relevant amending instrument is S.I. 2007/3464. There are other amending instruments but none is relevant.
