The Secretary of State for Communities and Local Government makes this Order in exercise of the powers conferred by section 1(7) of the Derelict Land Act 1982(1) and with the consent of the Treasury in accordance with section 1(8)(b) of that Act:

Citation and commencement

1.  This Order may be cited as the Derelict Land Clearance Area (Drake Gardens, Tavistock) Order 2009 and shall come into force on 23rd December 2009.

Derelict Land Clearance Area

2.—(1) Subsections (1) to (6) of section 1 of the Derelict Land Act 1982 shall have effect in relation to the land in the locality shown bounded by the outside edge of a bold red line on the map as they have effect in relation to land in a development area or intermediate area.

(2) In paragraph (1) “the map” means the map marked “Map referred to in the Derelict Land Clearance Area (Drake Gardens, Tavistock) Order 2009” and signed by authority of the Secretary of State, duplicates of which have been deposited, and are available for inspection, at the offices of the West Devon Borough Council and at the offices of the Secretary of State.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order specifies an area in Drake Gardens, Tavistock, West Devon as a derelict land clearance area. Former lead mining has caused actual and apprehended collapse of the surface of land in that locality. The land is not in a development or intermediate area specified under section 1 of the Industrial Development Act 1982 (c.52).

Under section 1(7) of the Derelict Land Act 1982, the Secretary of State may, with the consent of the Treasury, specify land by order so that the preceding provisions of that section have effect as if the land were in a development or intermediate area. This means that the local authority in whose area the specified land is situated may apply for grant at the higher rates towards expenditure incurred, in reclaiming, improving or bringing it back into use.

The area is shown on the map referred to in the Order. A copy of the map is available for inspection at West Devon Borough CouncilOffices, Kilworthy Park, Drake Road, Tavistock, Devon, PL19 0BZ and at the Department for Communities and Local Government, Eland House, Bressenden Place, London SW1E 5DU.

A full impact assessment has not been produced for this Order as no impact on the private or voluntary sectors is foreseen.
