Saving Gateway Accounts

The Treasury make the following Order in exercise of the powers conferred by sections 28(1) and 31 of the Saving Gateway Accounts Act 2009(1):
1. This Order may be cited as the Saving Gateway Accounts Act 2009 (Commencement No. 1) Order 2009.
2. 1st January 2010 is the appointed day for the coming into force of the following sections of the Saving Gateway Accounts Act 2009:
(a)section 4(1);
(b)section 5(1);
(c)section 18;
(d)section 23(1) excluding paragraphs (b) to (e); and
(e)sections 24 and 25 in so far as those sections apply to an appeal under section 23(1)(a).

This Order brings into force various sections of the Saving Gateway Accounts Act 2009 (‘the Act’) on 1 January 2010.
Sections 4, 5, 23(1)(a), 24 and 25 of the Act relate to the approval of account providers by Her Majesty’s Commissioners for Revenue and Customs to offer and provide Saving Gateway accounts to persons eligible for a Saving Gateway account once the new Saving Gateway scheme is introduced under the Saving Gateway Accounts Act 2009 and to the provision of account providers’ right to appeal against any such refusal of approval by the Commissioners.
Section 18 of the Act amends sub-section 121F(2) of the Social Security Administration Act 1992 (c.5) and the corresponding provision in the Social Security Administration (Northern Ireland) Act 1992 (c.8) so as to allow the Department of Work and Pensions or the Secretary of State thereof to provide certain specified information to Her Majesty’s Revenue and Customs in connection with their functions relating to Saving Gateway accounts.
