The Defence Council, in exercise of the powers conferred by section 340 of the Armed Forces Act 2006(1), make the following Regulations:

1.  These Regulations may be cited as the Armed Forces (Aliens) Regulations 2009 and come into force on 31st October 2009.

2.  Section 340(1) of the Armed Forces Act 2006 shall not apply to a citizen or national of Nepal who serves, or has for not less than five years served, in the Brigade of Gurkhas.

EXPLANATORY NOTE

(This note is not part of the Regulations)

Section 340(1) of the Armed Forces Act 2006 prohibits aliens from serving in the regular forces or any of Her Majesty’s forces raised under the law of a British overseas territory. These Regulations lift that prohibition in the case of citizens or nationals of Nepal who serve in the Brigade of Gurkhas, or who after five years of such service transfer to serve in other units of the regular forces or the forces of a British overseas territory.
