The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by section 25(1)(b) of the Dartford-Thurrock Crossing Act 1988(1):

Citation and commencement

1.  These Regulations may be cited as the Dartford-Thurrock Crossing (Amendment) Regulations 2010 and come into force on 12th July 2010.

Amendment of Regulations

2.—(1) The Dartford-Thurrock Crossing Regulations 1998(2) are amended as follows.

(2) In regulation 5 (dangerous goods), for paragraph (1), substitute—

(1) Subject to regulation 6, no person shall, except with the permission of the crossing operator, take or cause or permit to be taken into the tunnels any vehicle conveying any article or substance the name and description of which appears in column (2) of Table A unless the tunnel restriction code, shown in brackets in column (15) of Table A relating to that article or substance, is—

(a)a “D”, “D/E”, “E” or “-”;

(b)where carriage is other than by tank, a “B/D”, “B/E”, “C/D” or “C/E”; or

(c)a “C5000D” where the total net explosive mass per transport unit does not exceed 5000kg.

(3) After regulation 5(2) add—

(3) In this regulation—

“Table A” means Table A of Chapter 3.2 of Part 3 of Annex A (general provisions and provisions concerning dangerous substances and articles) to the European Agreement Concerning the International Carriage of Dangerous Goods by Road applicable as from 1st January 2009(3);

“tank” and “transport unit” have the same meanings as in Chapter 1.2 of Part 1 of Annex A to that Agreement.

(4) For regulation 6 substitute—

6.  The prohibition in paragraph (1) of regulation 5 does not apply in the circumstances detailed in paragraph 1.1.3 (exemptions) of Chapter 1 of Part 1 of Annex A (general provisions and provisions concerning dangerous substances and articles) of the European Agreement Concerning the International Carriage of Dangerous Goods by Road applicable as from 1st January 2009.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations update the list of dangerous goods prohibited from being carried through the tunnels at the Dartford-Thurrock Crossing by amending regulations 5 and 6 of the Dartford-Thurrock Crossing Regulations 1998. In describing the articles and substances which may be carried through the tunnels, references to parts of the booklet Dangerous Traffic 14th Edition issued in 2007 are deleted and the tunnel restriction codes set out in the European Agreement Concerning the International Carriage of Dangerous Goods by Road, (2009 edition) are substituted.

In some circumstances the provisions laid down in the European Agreement Concerning the International Carriage of Dangerous Goods by Road, (2009 edition) do not apply. Those circumstances are described in paragraph 1.1.3 (exemptions) of Chapter 1 of Part 1 of Annex A to that Agreement.

An impact assessment has not been produced for this instrument as there is no anticipated impact on the private or voluntary sectors and costs to the public sector are estimated at less than £5 million.
