The Secretary of State for Health makes these Regulations in exercise of the powers conferred by paragraphs 1(5A), 8(1) and (2) and 29(2) and (3) of Schedule 1 to the Health Protection Agency Act 2004(1).
In accordance with paragraphs 1(7) and 8(4) of Schedule 1 to that Act the Secretary of State has consulted the Scottish Ministers, the Department of Health, Social Services and Public Safety in Northern Ireland and the Welsh Ministers(2).
2004 c.17; paragraphs 1 and 29 of Schedule 1 were amended by the Health Act 2009 (c.21), section 19 and Schedule 3, Part 1, paragraphs 4 to 6.
See paragraph 30 of Schedule 1 to the Health Protection Agency Act 2004 (c.17) for the definition of devolved authority. By virtue of paragraph 30(1)(c) of Schedule 11 to the Government of Wales Act 2006 (c.32) functions conferred on the National Assembly for Wales under the 2004 Act are transferred to the Welsh Ministers.
