The Secretary of State makes the following Order in exercise of the powers conferred by section 93(2) of the Local Government, Planning and Land Act 1980(1) (“the Act”).
Pursuant to section 93(4) of the Act, the Secretary of State has sent written notification that he proposes to make this Order to each of the bodies to whom Part X of the Act will apply by virtue of the Order and, as required by section 93(6) of the Act, a period of 42 days from the date of that notification has expired.
1980 c.65. The functions of the Secretary of State under section 93 are, so far as exercisable in relation to Wales, vested in the Welsh Ministers. Those functions were transferred to the National Assembly for Wales constituted by the Government of Wales Act 1998 (c. 38) by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), article 2, Schedule 1. By virtue of paragraphs 30 and 32 of Schedule 11 to the Government of Wales Act 2006 (c.32), they were transferred to the Welsh Ministers immediately after the end of the initial period as defined by section 161(5) of that Act.
