The Secretary of State, in exercise of the powers conferred by sections 22 and 42(6) of the Teaching and Higher Education Act 1998(1) makes the following Regulations:

Citation, commencement and application

1.—(1) These Regulations may be cited as the Education (Student Support) (European University Institute) Regulations 2010 (Amendment) (No. 2) Regulations 2011 and come into force on 1st November 2011.

(2) These Regulations apply in relation to the provision of support to students in relation to an academic year which begins on or after 1st September 2012 whether anything done under these Regulations is done before, on or after 1st September 2012.

(3) These Regulations apply in relation to England(2).

Amendment of the Education (Student Support) (European University Institute) Regulations 2010

2.—(1) The Education (Student Support) (European University Institute) Regulations 2010(3) are amended as follows.

(2) In regulation 3, in the definition of “relevant date”, for “1st February 2011” substitute “1st February 2012”.

(3) In regulation 8(3), for “1st September 2011” substitute “1st September 2012” and for “11th February 2011” substitute “31st January 2012”.

(4) In regulation 9(15)—

(a)for “1st September 2011”, substitute “1st September 2012”,

(b)for “30th April 2011”, substitute “30th April 2012”, and

(c)for “28th February 2012”, substitute “28th February 2013”.

EXPLANATORY NOTE

(This note is not part of the Order)

These Regulations amend the Education (Student Support) (European University Institute) Regulations 2010 (S.I. 2010/447) (“the 2010 Regulations”). The 2010 Regulations (as amended by S.I. 2011/83) provide support for eligible students taking designated higher education courses at the European University Institute in respect of an academic year beginning on or after 1st September 2011. The amended Regulations will apply to such courses beginning on or after 1st September 2012.

Regulation 2(2) provides that the “relevant date” is 1st February 2012.

Regulations 2(3) and (4) amend the deadline for applications and the deadline for receipt of financial information, in relation to the academic year beginning on or after 1st September 2012.

An impact assessment has not been produced for this instrument as it has no impact on the costs of business, charities or voluntary bodies. The impact on the public sector is minimal.

In relation to Wales, the functions of the Secretary of State under section 22 of the Teaching and Higher Education Act 1998 were transferred to the Welsh Ministers under section 44 of the Higher Education Act 2004 except so far as they relate to the making of any provision authorised by subsection (2)(a), (c), (j) or (k), (3)(e) or (f) or (5) of section 22.
