The Greater London Authority Act 1999 (Amendment) Order 2012

The Secretary of State for Health makes the following Order, in exercise of the powers conferred by sections 31(9) and 420(1) of the Greater London Authority Act 1999(1).

A draft of the Order was laid before Parliament in accordance with section 420(3)(b) of the Greater London Authority Act 1999 and approved by resolution of each House.

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Greater London Authority Act 1999 (Amendment) Order 2012 and shall come into force on 1st July 2012.

(2) In this Order, “the Act” means the Greater London Authority Act 1999.

Amendment to section 31 of the Act

2.—(1) Section 31 of the Act (limits of the general power) is amended as follows.

(2) After subsection (5), insert—

(5A) Any reference in subsection (3) above to the provision of health services does not include a reference to the provision of services or facilities for promoting improvements in, or protecting, public health..

(3) In subsection (6), for “(5)” substitute “(5A)”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Greater London Authority Act 1999 (“the Act”).

It amends section 31 of the Act to allow the Authority to incur expenditure on providing services or facilities promoting improvements in, or protecting, public health to further one or more of the principal purposes of the Authority, and which the Authority considers appropriate for improving the health of people in Greater London(2).

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.

For various purposes under the Act, Greater London means the London Boroughs, the City of London and the Inner and Middle Temple.
