Her Majesty, in exercise of the powers in section 2(5)(b) and (6) of the Health Service Commissioners Act 1993(1), is pleased, by and with the advice of Her Privy Council, to order, and it is ordered, as follows:
1. This Order may be cited as the Health Service Commissioner for England (Special Health Authorities) Order 2012 and comes into force on 17th January 2013.
2. The Special Health Authorities(2) listed in the Schedule are designated as Special Health Authorities to which section 2(1) of the Health Service Commissioners Act 1993 (bodies subject to investigation by the Health Service Commissioner for England) applies.

This Order designates three Special Health Authorities, Health Education England, the Health Research Authority and the National Health Service Trust Development Authority, as health service bodies subject to investigation by the Health Service Commissioner for England under section 2 of the Health Service Commissioners Act 1993.
1993 c.46. Section 2(5) was amended by sections 112 (subsequently repealed by section 163 of, and Schedule 12 to, the Government of Wales Act 2006 (c.32)) and 152 of, and paragraph 3(3) of Schedule 10 and Part 1 of Schedule 18 to, the Government of Wales Act 1998 (c. 38). Section 2(6) was substituted by section 39(1) of, and paragraph 31(1) and (4) of Schedule 6 to, the Public Services Ombudsman (Wales) Act 2005 (c. 10).
Special Health Authorities are bodies corporate established under section 28 of the National Health Service Act 2006 (c. 41). Section 28 is amended by section 55(1) of, and paragraph 13 of Schedule 4 to, the Health and Social Care Act 2012 (c.7), with effect from a date to be appointed under that Act.
