The Secretary of State for Education makes the following Order in exercise of the powers conferred by sections 122(5) and 210(7) of the Education Act 2002(1) (“the Act”).
In accordance with section 126 of the Act(2) the Secretary of State has consulted such of the persons and bodies referred to in that section as appeared to him to be appropriate.
1. This Order may be cited as the Education (School Teachers’ Prescribed Qualifications, etc) (Amendment) Order 2012 and comes into force on 1st April 2012.
2. The Education (School Teachers’ Prescribed Qualifications, etc) Order 2003(3) is amended as follows.
3. In article 3, in the definition of “accredited institution”, for “Training and Development Agency for Schools” substitute “Secretary of State”.
4. In article 7(1)(b) for “been awarded qualified teacher status by the General Teaching Council for England in accordance with regulation 10 of those Regulations” substitute “qualified teacher status(4)”.
5. For article 7(2)(b) substitute—
“(b)the “teacher trainee skills tests” means the literacy and numeracy teacher trainee skills tests administered by the Secretary of State”.

This Order amends the Education (School Teachers’ Prescribed Qualifications, etc) Order 2003 with effect from 1st April 2012.
The amendments—
(a)make amendments relating to the abolition of the Training and Development Agency for Schools on 1st April 2012 (article 3 and 5);
(b)delete a reference to the General Teaching Council for England which is being abolished from the same date (article 4); and
(c)remove a reference to the information, communications and technology skills test that is no longer a requirement for those seeking to become a qualified teacher in England (article 5).
An impact assessment has not been produced for this instrument as it has no impact on businesses or civil society organisations. The instrument has a minimal impact on the public sector.

Section 126 of the Education Act 2002 was amended by S.I. 2010/1158.
S.I. 2003/1709; references to the Training and Development Agency for Schools were substituted for references to the Teacher Training Agency by virtue of paragraph 2 of Schedule 15 to the Education Act 2005 (c.18). Schedule 15 is repealed by paragraphs 30 and 33 of Schedule 5 to the Education Act 2011 (c.21) (not yet in force).
As to status as a qualified teacher see section 132 of the Education Act 2002 and the regulations made under that section (S.I. 2003/1662).
