The Secretary of State, in exercise of the powers conferred by sections 43(3)(a) and 104(2) of the Energy Act 2008(1), makes the following Order:

Citation and commencement

1.  This Order may be cited as the Feed-in Tariffs (Amendment) Order 2014 and comes into force on 14th July 2014.

Amendment to the Feed-in Tariffs Order 2012

2.  After article 17 of the Feed-in Tariffs Order 2012(2), insert—

Withdrawal of preliminary accreditation for certain hydro generating stations

17A.(1) The Authority must withdraw any preliminary accreditation granted under article 9 in respect of a relevant hydro generating station if—

(a)it is requested to do so by notice from the prospective FIT generator in respect of that relevant hydro generating station; and

(b)it is satisfied that the application for preliminary accreditation in respect of the relevant hydro generating station was received by the Authority during the period beginning with 1st December 2012 and ending with 31st December 2012.

(2) Where the Authority withdraws a preliminary accreditation in accordance with paragraph (1) it must give notice to the prospective FIT generator specifying the date on which the withdrawal has effect.

(3) In this article—

“prospective FIT generator” has the same meaning as in article 9; and

“relevant hydro generating station” means a hydro generating station with a total installed capacity greater than 100kW but not exceeding 500kW.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order, which extends to Great Britain, amends the Feed-in Tariffs Order 2012 (“the 2012 Order”).

The Order inserts article 17A (withdrawal of preliminary accreditation for certain hydro generating stations) into the 2012 Order to place an obligation on the Gas and Electricity Markets Authority (“the Authority”) to withdraw a granted preliminary accreditation in certain circumstances. Those circumstances are where the Authority has received a request from a particular category of prospective Feed-in Tariff hydro generator who made an application for preliminary accreditation in the period from 1st December 2012 to 31st December 2012.

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
