The Secretary of State, in exercise of the powers conferred by section 6(3) of the Self-build and Custom Housebuilding Act 2015(1), makes the following Regulations:
1. These Regulations may be cited as the Self-build and Custom Housebuilding Act 2015 (Commencement) Regulations 2016.
2. The day appointed for the coming into force of the Self-build and Custom Housebuilding Act 2015 is 1st April 2016, so far as it is not already in force on that date.
Signed by authority of the Secretary of State for Communities and Local Government
Brandon Lewis
Minister of State for Housing and Planning
Department for Communities and Local Government
3rd February 2016
(This note is not part of the Regulations)
These regulations bring into force the provisions of the Self-build and Custom Housebuilding Act 2015 (c.17) that are not yet in force on 1st April 2016. Section 6 of the Act commenced on Royal Assent. The remaining provisions are sections 1 to 5 of, and the Schedule to, the Act. The Act places duties on certain public authorities to keep a register of individuals and associations of individuals who are seeking to acquire serviced plots of land in the authority’s area in order to bring forward self-build and custom housebuilding projects, and to have regard to that register in carrying out their planning and other functions. The Schedule to the Act enables the making of Regulations that make provision in relation to registers.
