The Secretary of State for Health makes the following Regulations in exercise of the powers conferred by sections 13A(9) and 272(7) of the National Health Service Act 2006(1).
In accordance with section 13A(1) of that Act, the Secretary of State has published and laid before Parliament the mandate(2).
1.—(1) These Regulations may be cited as the National Health Service (Mandate Requirements) Regulations 2016 and come into force on 1st April 2016.
(2) These Regulations cease to have effect at the end of 31st March 2017.
2. The requirements set out in paragraph 6.2 of the Annex in the mandate to the National Health Service Commissioning Board(3) published by the Secretary of State on 17th December 2015 and laid before Parliament on that date(4) have effect.

Regulation 2 of these Regulations gives effect to the requirements set out in the Secretary of State’s mandate to the National Health Service Commissioning Board for the financial year from 1st April 2016 to 31st March 2017. The mandate was laid before Parliament and published on 17th December 2015.

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
2006 c.41 (“the 2006 Act”). Section 13A was inserted by section 23(1) of the Health and Social Care Act 2012 (c.7) (“the 2012 Act”). By virtue of section 271(1) of the 2006 Act, the powers exercised in making these Regulations are exercisable by the Secretary of State only in relation to England. See section 275(1) of the 2006 Act for the definition of “regulations”.

The National Health Service Commissioning Board was established by section 1H of the 2006 Act, as inserted by section 9(1) of the 2012 Act.
