The Secretary of State, in exercise of the powers conferred by sections 59, 60 and 333(7) of the Town and Country Planning Act 1990(1), makes the following Order:
1. This Order may be cited as the Town and Country Planning (Operation Stack) Special Development (Amendment) Order 2017 and comes into force on 31st December 2017.
2. The Town and Country Planning (Operation Stack) Special Development Order 2015(2) is amended as follows.
3. In article 3 (temporary planning permission), in paragraph (2) for “at the end of 31st December 2017” substitute “at the end of 31st December 2019”.
4. In article 4 (conditions and limitations), in paragraph (3) for “31st December 2017” substitute “31st December 2019”.

This Order further amends the Town and Country Planning (Operation Stack) Special Development Order 2015 to provide that the planning permission granted by that Order ceases at the end of 31st December 2019 rather than the end of 31st December 2017.
A regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen. An Explanatory Memorandum is published alongside this Order at www.legislation.gov.uk
1990 c. 8. Section 59 was amended by the Growth and Infrastructure Act 2013 (c. 27), paragraph 4 of Schedule 1. Section 60 was amended by section 4(1) of that Act and the Housing and Planning Act 2016 (c. 22), section 152(1). There are further amendments to sections 59 and 333 that are not relevant to these Regulations.
