Coming into force in accordance with regulation 1
The Secretary of State makes these Regulations in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018(1).
The requirements of paragraph 3(2) of Schedule 7 to the European Union (Withdrawal) Act 2018 (relating to the appropriate Parliamentary procedure for these Regulations) have been satisfied.
1. These Regulations may be cited as the Livestock (Records, Identification and Movement) (England) (Amendment) (EU Exit) Regulations 2018 and come into force on exit day.
2.—(1) The Cattle Identification Regulations 2007(2) are amended as follows.
(2) In regulation 2(1), in the definition of “cattle passport”, for sub-paragraph (a) substitute—
“(a)a cattle passport issued in England under regulation 6 of, and schedule 3 to, these Regulations or the equivalent measures in Wales or Scotland;”
(3) In regulation 10(3)(h), for “a representative of the European Commission or any other” substitute “any”.
(4) In Schedule 1, omit paragraph 8.
(5) In Schedule 2, in the heading to paragraph 4 and in paragraph 4(1), for “another” substitute “a”.
(6) In Schedule 3, in part 2, omit paragraph 13(2).
3.—(1) The Sheep and Goats (Records, Identification and Movement) (England) Order 2009(3) is amended as follows.
(2) In article 2, in the definitions of “export”, “identification mark”, and “method of identification”, for “another” substitute “a”.
(3) In article 29, in the heading and in paragraphs (1) and (2), for “another” substitute “a”.
(4) In article 35(1)(g), omit “a representative of the European Commission acting for the purposes of Article 12 of the Council Regulation, or”.
(5) In article 38(d), for “another” substitute “a”.
4.—(1) The Pigs (Records, Identification and Movement) Order 2011(4) is amended as follows.
(2) In article 8(2)(c), for “purposes of intra-Community trade or export” substitute “purpose of export”.
(3) In article 10, for “purposes of intra-Community trade or export” substitute “purpose of export”.

These Regulations are made in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of domestic legislation to operate effectively and other deficiencies (in particular under section 8(2)(c) and (g)) arising from the withdrawal of the UK from the European Union.
These Regulations make amendments to subordinate legislation concerned with the records, identification and movement of cattle, sheep, goats and pigs in relation to England.
An impact assessment has not be produced for this instrument as no, or no significant, impact on the private of voluntary sector is foreseen.
