The Secretary of State, in exercise of the powers conferred by section 70(2) of the Children and Social Work Act 2017(1), makes the following Regulations:

Citation and interpretation

1.  These Regulations may be cited as the Children and Social Work Act 2017 (Commencement No. 5) Regulations 2018.

2.  “The Act” means the Children and Social Work Act 2017.

Provisions coming into force on 1st September 2018

3.  To the extent that they are not already in force, the following provisions of the Act come into force on 1st September 2018—

(a)section 36 (Social Work England); and

(b)Schedule 3 (Social Work England).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations are the fifth commencement regulations made under the Children and Social Work Act 2017 (c.16) (“the Act”). Section 10, Schedule 1 and Part 3 of the Act came into force when the Act was passed.

Regulation 3 fully commences section 36 (3) and brings into force the remaining provisions of Schedule 3 to the Act which relate to Social Work England (“the regulator”). The provisions relate to: the power to delegate functions; the membership of committees; and the requirement to maintain records and accounts and to produce annual accounts to the Secretary of State and the Comptroller and Auditor General.

A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
