The Secretary of State makes these Regulations in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018 M1.
The requirements of paragraph 3(2) of Schedule 7 to the European Union (Withdrawal) Act 2018 (relating to the appropriate Parliamentary procedure for these Regulations) have been satisfied.

1. These Regulations may be cited as the Organic Products (Amendment) (EU Exit) Regulations 2019 and come into force on exit day.

2.—(1) The Organic Products Regulations 2009 M2 are amended as follows.
(2) In regulation 2(1)—
(a)in the definition of “specified EU provision” omit “EU”;
(b)insert at the appropriate place—
““third country” means any country or territory other than—
(a)the United Kingdom,
(b)the Bailiwick of Guernsey,
(c)the Bailiwick of Jersey, or
(d)the Isle of Man.”.
[F1(3) In regulation 6(1) for “the European Union” substitute “Great Britain”].
[F2(4) In regulation 7(1) for “the European Union” substitute “Great Britain”].
(5) In regulation 18 omit “EU” in both places.
(6) In regulation 22—
(a)omit “EU” in both places;
[F3(b)in paragraph (2) for “the European Union” substitute “Great Britain”].
(7) In regulation 23—
(a)in paragraph (1) omit “EU”;
(b)in paragraph (2) omit “, including any representative of the European Commission”.
(8) In regulation 26(1)(a) omit “EU”.
(9) In the Schedule—
(a)in the heading omit “EU”;
(b)in the table at column 1 omit “Article 25(1) of the Council Regulation”;
(c)in the table at column 2 omit “Articles 57 and 58 of Commission Regulation 889/2008”;
(d)in the table at column 3 omit the words from “Use of the” to “products”.

These Regulations are made in exercise of the powers in section 8(1) of the European Union (Withdrawal) Act 2018 (c. 16) to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(d) and (g)) arising from the withdrawal of the United Kingdom from the European Union.
These Regulations make amendments to subordinate legislation relating to organic products.
