The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 112(1)(b), 113A(1)(b), 113B(1)(b), and 125 of the Police Act 1997(1) as extended to Jersey by the Police Act 1997 (Criminal Records) (Jersey) Order 2010(2).

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Police Act 1997 (Criminal Records and Registration) (Jersey) (Amendment) Regulations 2019 and come into force at the end of the period of one week beginning with the day on which they are registered in the Royal Court of Jersey.

(2) These Regulations extend to Jersey.

Amendments to the Police Act 1997 (Criminal Records and Registration) (Jersey) Regulations 2010

2.—(1) The Police Act 1997 (Criminal Records and Registration) (Jersey) Regulations 2010(3) are amended as follows.

(2) For regulation 3 (fees for criminal record certificates and enhanced criminal record certificates), substitute—

Fees for criminal conviction certificates, criminal record certificates and enhanced criminal record certificates

3.  The fee payable in relation to an application for the issue of a criminal conviction certificate, a criminal record certificate or an enhanced criminal record certificate is prescribed as–

(a)£23 in the case of a criminal conviction certificate;

(b)£23 in the case of a criminal record certificate;

(c)£40 in the case of an enhanced criminal record certificate, and an additional £6 where an urgent preliminary response is sought under section 113E(3)(b),

save that no fee is payable in relation to an application made by a volunteer..

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations substitute the prescribed fees for criminal records certificates and enhanced criminal records certificates in the Police Act 1997 (Criminal Records and Registration) (Jersey) Regulations 2010 (S.I. 2010/1087) and insert a new fee of £23 for criminal conviction certificates (also known as basic certificates).

The fees for criminal records certificates (also known as standard certificates) are reduced from £26 to £23, and the fees for enhanced criminal records certificates are reduced from £44 to £40. This will mirror the fee reductions applied to applications for certificates in England and Wales.

The new and substituted fees apply to applications for criminal conviction certificates, criminal records certificates and enhanced criminal records certificates in Jersey.

1997 c. 50. Sections 113A and 113B were inserted by section 163(2) of the Serious Organised Crime and Police Act 2005 (c. 15). There are other amendments to the Police Act 1997 which are not relevant to these Regulations.

S.I. 2010/765. Article 3 extended sections 112, 113A, 113B and 125 of the Police Act 1997 to Jersey with modifications. The modifications are made in Schedule 1 of the 2010 Order. The Order was amended by S.I. 2012/2591.
