The Secretary of State makes this Order in exercise of the powers conferred by the provisions of the Acts listed in the Schedule.
The Secretary of State has been designated for the purposes of section 2(2) of the European Communities Act 1972(1) in relation to the environment(2).
The Secretary of State has consulted the Council of the Isles of Scilly in accordance with section 222(2) of the Water Industry Act 1991(3), section 224(2) of the Water Resources Act 1991(4) and section 117(2) of the Environment Act 1995(5).
The Secretary of State has consulted the Environment Agency in accordance with section 97(3) of the Water Resources Act 1991.
The Secretary of State has consulted in accordance with Article 9 of Regulation (EC) No 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety(6).
