The Secretary of State makes this Order in exercise of the powers conferred by section 90(3) and (5) of, and Schedule 6 to, the Climate Change Act 2008(1).

Citation and commencement

1.—(1) This Order may be cited as the Single Use Carrier Bags Charges (England) (Amendment) Order 2020.

(2) It comes into force on 21st March 2020.

Amendment to the Single Use Carrier Bags Charges (England) Order 2015

2.  The Single Use Carrier Bags Charges (England) Order 2015(2) is amended in accordance with article 3.

Amendment of Schedule 2

3.  In Schedule 2, in paragraph 2—

(a)in sub-paragraph (1)—

(i)at the beginning insert “Subject to sub-paragraph (1A),”;

(b)after paragraph (i) insert—

(j) Online grocery delivery bagA bag intended to be used solely to carry goods purchased for home delivery as part of an online grocery delivery service. ;

(c)after sub-paragraph (1) insert—

(1A) Online grocery delivery bags are excluded bags from 21st March to 21st September 2020 only..

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Single Use Carrier Bags Charges (England) Order 2015 (S.I. 2015/776).

Article 3 amends the list of “excluded bags” so that the obligation to charge for a single use carrier bag does not apply to bags intended to be used solely to carry goods purchased for home delivery as part of an online grocery delivery service. Such bags would be excluded from the obligation to charge from 21st March to 21st September 2020 only.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sector is foreseen.
