The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 138(1)(a), (2) and (4) and 175(1), (3), (4) and (5) of the Social Security Contributions and Benefits Act 1992(1), and sections 1(1), 5(1)(a), (i) and (q), 189(1), (4) and (5) and 191 of the Social Security Administration Act 1992(2).
The Secretary of State, considering that the authorisation of the use of electronic communications by these Regulations for any purpose is such that the extent (if any) to which records of things done for that purpose will be available will be no less satisfactory in cases where use is made of electronic communications than in other cases, makes the following Regulations in exercise of the powers conferred by sections 8 and 9(5) of the Electronic Communications Act 2000(3).
The Social Security Advisory Committee has agreed that the proposals in respect of these Regulations should not be referred to it(4).
1992 c. 4. Section 138 was substituted by section 70(1) of the Social Security Act 1998 (c. 14) and sub-section (1)(a) was amended by Part 8 of Schedule 14 to the Welfare Reform Act 2012 (c. 5). Section 138(4) is cited for the meaning of “prescribed”. Section 175(1) was amended by Schedule 3, paragraph 29(1) and (2), to the Social Security Contributions (Transfer of Functions, etc.) Act 1999 (c. 2) and section 175(4) was amended by paragraph 29(1) and (4) of that Schedule. Section 175(5) was amended by paragraph 36 of Schedule 1 to the Social Security (Incapacity for Work) Act 1994 (c. 18).
1992 c. 5. Section 189(1) was amended by Schedule 3, paragraph 57, to the Social Security Contributions (Transfer of Functions, etc.) Act 1999 (c. 2), and Schedule 6, paragraph 1, to the Tax Credits Act 2002 (c. 21). Section 189(4) was amended by S.I. 2013/252. Section 189(1), (4) and (5) was also amended by paragraph 109 of Schedule 7, and Schedule 8, to the Social Security Act 1998 (c. 14). Section 191 is cited for the meanings of “benefit” and “prescribe”.
