The Secretary of State, in exercise of the powers conferred by sections 14(1) and 240(10) of the Local Government and Public Involvement in Health Act 2007(1), makes the following Regulations.

Citation and commencement

1.  These Regulations may be cited as the Local Government (Structural Changes) (Coronavirus) (Amendment) Regulations 2020 and come into force on 24th August 2020.

Amendment of the Local Government (Structural Changes) (Transitional Arrangements) (No. 2) Regulations 2008

2.—(1) The Local Government (Structural Changes) (Transitional Arrangements) (No. 2) Regulations 2008(2) are amended in accordance with paragraph (2).

(2) In regulation 12 (plans, reviews, rules, schemes, etc)—

(a)in the heading after “24 months” insert “or 36 months”;

(b)in paragraph (5) at the beginning insert “Subject to paragraph (5B)”;

(c)after paragraph (5) insert—

(5A) Paragraph (5B) applies in relation to single tier councils which have reorganisation dates in 2019, 2020 or 2021.

(5B) Where a plan, review, scheme, statement or strategy of a description in paragraph (1)(a)(i), (1)(a)(iv), (1)(b)(i), (1)(c)(i) or (1)(c)(ii) has not been completed, formulated or prepared (as the case may be) and, where required by or under the enactment concerned, published, before the reorganisation date, the single tier council that is related to the council authorised by that paragraph to take that action shall take such steps as are necessary to secure that the plan, review, scheme, statement or strategy is completed, formulated or prepared (as the case may be) and, where required by or under the enactment concerned, published, as soon as practicable and not later than the date that falls 36 months after the reorganisation date.;

(d)in paragraph (6) after “paragraph (5)” insert “or (5B) as the case may be”;

(e)in paragraph (7) after “paragraph (5)” insert “or (5B) as the case may be”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Local Government (Structural Changes) (Transitional Arrangements) (No. 2) Regulations 2008 to change the date by which certain plans, reviews, schemes, statements and strategies are required from 24 months to 36 months after the reorganisation date for single tier councils which have reorganisation dates in 2019, 2020 or 2021.

A full impact assessment has not been prepared for this instruments as no, or no significant, impact on the private, voluntary or public sector is foreseen.
