PART 1Introduction

Citation and commencement

1.  These Regulations may be cited as the UK Statistics (Amendment etc.) (EU Exit) Regulations 2021 and come into force on the 22nd day after the day on which they are laid.

PART 2Amendment to primary legislation

Amendment of the Data Protection Act 2018

2.  In paragraph 1(3) of Schedule 1 to the Data Protection Act 2018(1), in the definition of “social protection”, for “exit day” substitute “IP completion day”.

PART 3Amendments to subordinate legislation

Amendment of the Public Contracts Regulations 2015

3.  In Schedule 2 to the Public Contracts Regulations 2015(2) (activities constituting works), for “exit day” substitute “IP completion day”.

Amendment of the Electricity Supplier Obligations (Amendment & Excluded Electricity) Regulations 2015

4.  In regulation 2(1) of the Electricity Supplier Obligations (Amendment & Excluded Electricity) Regulations 2015(3) (interpretation), in the definition of “NACE Rev 2”, for “exit day” substitute “IP completion day”.

Amendment of the Concession Contracts Regulations 2016

5.  In Schedule 1 to the Concession Contracts Regulations 2016(4) (activities constituting works), for “exit day” substitute “IP completion day”.

Amendment of the Utilities Contracts Regulations 2016

6.  In Schedule 1 to the Utilities Contracts Regulations 2016(5) (activities constituting works), for “exit day” substitute “IP completion day”.

PART 4Revocation of retained direct EU legislation and saving

Revocation of retained direct EU legislation and saving

7.—(1) The legislation set out in Schedule 1, so far as it forms part of domestic law by virtue of section 3(1) of the European Union (Withdrawal) Act 2018(6), is revoked.

(2) The points in Annex XXI to the EEA agreement, as it forms part of domestic law, set out in Schedule 2 are omitted.

(3) Notwithstanding the revocation of Council Regulation (EC) No 2223/96, the reference to paragraph 2.48 of Annex A to that Regulation in section 17(3B)(a) (power to obtain information) of the Bank of England Act 1998(7) is to be read as reference to that paragraph as it had effect immediately before the Regulation was revoked.
