The Secretary of State makes this Order in exercise of the powers conferred by sections 87, 88 and 97(1) of, and paragraph 6(a) of Schedule 8 and paragraphs 5 and 8 of Schedule 10 to, the Natural Environment and Rural Communities Act 2006(1) (“the Act”).
As required by section 97(5) of the Act, the Secretary of State has consulted with such organisations as appear to the Secretary of State to be representative of interests substantially affected by this Order.
As required by section 96(1)(e) of the Act, the Secretary of State makes this Order with the approval of the relevant Northern Ireland department(2); the Scottish Ministers (as required by section 96(4) of the Act, a draft of this Order was laid before, and approved by resolution of, the Scottish Parliament before the Scottish Ministers gave their approval); and the Welsh Ministers(3).
In accordance with section 97(8)(a) of the Act, a draft of this Order has been laid before, and approved by a resolution of, each House of Parliament.
2006 c. 16. For the meaning of “appropriate authority”, see section 96(1) of the Natural Environment and Rural Communities Act 2006 (“the Act”).
The relevant Northern Ireland department is the Department for Agriculture, Environment and Rural Affairs as renamed by section 1(2) of the Departments Act (Northern Ireland) 2016 (c. 5 (N.I.)).
The functions of the National Assembly for Wales in section 96(1) of the Act are transferred to the Welsh Ministers by virtue of section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act 2006 (c. 32).
