The Secretary of State makes this Order in exercise of the powers conferred by sections 104, 112(1) and 113(2), (3), (4) and (5) of the Scotland Act 1998(1).

Part 1 Citation, commencement and extent

Citation, commencement and extent

1.—(1) This Order may be cited as the Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023 (Consequential Amendments) Order 2023.

(2) This Order comes into force on 19th November 2023.

(3) Part 1 of this Order extends to England and Wales, Scotland and Northern Ireland.

(4) Part 2 of this Order extends to England and Wales only.

(5) Part 3 of this Order extends to England and Wales and Scotland.

(6) Part 4 of this Order extends to Northern Ireland only.

Part 2 England and Wales

Amendment of the Social Security (Invalid Care Allowance) Regulations 1976

2.—(1) Regulation 7 of the Social Security (Invalid Care Allowance) Regulations 1976 (manner of electing the person entitled to a carer's allowance in respect of a severely disabled person where, but for section 70(7) of the Contributions and Benefits Act, more than one person would be entitled to a carer's allowance in respect of that severely disabled person)(2) is amended as follows.

(2) For the heading of regulation 7, substitute “manner of electing the person entitled to a carer’s allowance in respect of a severely disabled person for the purposes of section 70 of the Contributions and Benefits Act”.

(3) In paragraph (1), for “section 70(7)” substitute “section 70(7ZA)”.

(4) After paragraph (1), insert—

“(1C) For the purposes of section 70(7ZB) and (7ZC) of the Contributions and Benefits Act, which provides that where, apart from those subsections, one person (A) would have an entitlement mentioned in subsection (7ZB) and another person (B) would have a relevant entitlement for the same day in respect of the same severely disabled person, persons A and B may jointly elect in the prescribed manner that B shall have the relevant entitlement and that A shall not have an entitlement mentioned in subsection (7ZB), an election shall be made by giving the Secretary of State a notice in writing signed by both A and B specifying that B shall have the relevant entitlement and A shall not have an entitlement mentioned in subsection (7ZB).”.

(5) In paragraph (2)—

(a) for “paragraph (1)” substitute “paragraph (1) or (1C)”;

(b) after “a carer’s allowance” insert “, carer support payment”.

(6) After paragraph (3), insert—

“(5) In paragraph (2), “carer support payment” means carer’s assistance given in accordance with the Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023(3).”.

(7) The manner of election specified in regulation 7(1C), as inserted by paragraph (4) above, is to be regarded as being “the prescribed manner” within the meaning of section 70(7ZC)(a) of the Social Security Contributions and Benefits Act 1992.

Part 3 England and Wales and Scotland

Amendment of the Social Security (Credits) Regulations 1975

3.  In regulation 7A of the Social Security (Credits) Regulations 1975 (credits for carer’s allowance)(4)—

(a) in the heading, after “carer’s allowance” insert “or carer support payment”;

(b) in paragraph (1)—

(i) after “carer’s allowance”, in both places it occurs, insert “or carer support payment”;

(ii) after “would have been so payable but for” insert “regulation 16 of the Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023 or”;

(c) after paragraph (2) insert—

“(3) In this regulation “carer support payment” means carer’s assistance given in accordance with the Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023.”.

Amendment of the Social Security (Widow’s Benefit and Retirement Pensions) Regulations 1979

4.—(1) The Social Security (Widow’s Benefit and Retirement Pensions) Regulations 1979(5) are amended as follows.

(2) In regulation 4(1)(b) (days to be treated as days of increment)—

(a) at the end of sub-paragraph (iv), for “and” substitute “or”;

(b) after sub-paragraph (iv) insert—

“(v) carer support payment under the Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023; and”.

(3) In regulation 17 (provisions relating to age addition for persons not in receipt of a retirement pension), after paragraph (1)(g) insert—

“(ga) the Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023;”.

Amendment of the Income Support (General) Regulations 1987

5.—(1) The Income Support (General) Regulations 1987(6) are amended as follows.

(2) In regulation 2(1) (interpretation), after the definition of “care home” insert—

““carer support payment” means carer’s assistance given in accordance with the Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023;”.

(3) In paragraph 4(b) of Schedule 1B (prescribed categories of person)—

(a) after “carer’s allowance” insert “or carer support payment”;

(b) for “that allowance” substitute “a carer’s allowance”.

(4) In Schedule 2 (applicable amounts)—

(a) in paragraph 7—

(i) at the end of sub-paragraph (1)(a) omit “and”;

(ii) at the end of sub-paragraph (1)(b) insert “and”;

(iii) after sub-paragraph (1)(b) insert—

“(c) in the case of carer support payment, for any period during which, apart from regulation 16 of the Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023, he would be in receipt of that benefit.”;

Amendment of the Social Security (Claims and Payments) Regulations 1987

6.  In regulation 3A(6) of the Social Security (Claims and Payments) Regulations 1987 (notification that claim not required for entitlement to a category a or b retirement pension)(7), in the definition of “non-exempt benefit”, after sub-paragraph (a) insert—

“(ab) carer support payment under the Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023;”.

Amendment of the Income Support (Liable Relatives) Regulations 1990

7.  In regulation 2(1)(e) of the Income Support (Liable Relatives) Regulations 1990 (prescribed amounts for the purposes of section 24A of the Act)(8), after “carer’s allowance” insert “or carer support payment under the Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023,”.

Amendment of the Jobseeker’s Allowance Regulations 1996

8.—(1) The Jobseeker’s Allowance Regulations 1996(9) are amended as follows.

(2) In regulation 1(3) (interpretation), after the definition of “care home” insert—

““carer support payment” means carer’s assistance given in accordance with the Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023(10);”.

(3) In regulation 46(1)(a) and (d) (waiting days), for “or carer’s allowance” substitute “, carer’s allowance or carer support payment”.

(4) In regulation 48 (linking periods)—

(a) in paragraph (2)(a), after “a carer's allowance under section 70 of the Benefits Act” insert “or carer support payment”;

9.  In regulation 7 of the Social Security and Child Support (Decisions and Appeals) Regulations 1999 (date from which a decision superseded under section 10 takes effect)(11)—

(a) in paragraph (2)(bc), after “carer’s allowance”, in both places it occurs, insert “or carer support payment”;

(b) after paragraph (2) insert—

15.  In regulation 3(1)(a) of the Social Security (Deferral of Retirement Pensions) Regulations 2005 (amount of retirement pension not included in the calculation of the lump sum)(17), after sub-paragraph (iv) insert—

“(v) carer support payment under the Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023;”.

Amendment of the Social Fund Maternity and Funeral Expenses (General) Regulations 2005

16.  In regulation 10(1A) of the Social Fund Maternity and Funeral Expenses (General) Regulations 2005 (deductions from an award of a funeral payment)(18), after sub-paragraph (c) insert—

“(ca) carer support payment under the Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023;”.

Amendment of the Housing Benefit Regulations 2006

17.—(1) The Housing Benefit Regulations 2006(19) are amended as follows.

(2) In regulation 2(1) (interpretation), after the definition of “care home” insert—

““carer support payment” means carer’s assistance given in accordance with the Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023;”.

(3) After regulation 75F(1)(h) (exception to the benefit cap: receipt of specified benefit) insert—

“(ha) the claimant, the claimant's partner, or a young person for whom the claimant or the claimant's partner is responsible, is entitled to carer support payment;”.

(4) In Schedule 3 (applicable amounts)—

(a) in paragraph 7—

(i) at the end of sub-paragraph (1)(a) omit “and”;

(a) A and B jointly elect that B shall have entitlement to the carer element and that A shall not have an entitlement mentioned in paragraph (5)(a) for that day in respect of that severely disabled person; or

(b) in default of such an election, the Secretary of State is satisfied, following consultation with the Scottish Ministers, that—

(i) Scottish Ministers have decided, or will decide, that A shall not have an entitlement mentioned in paragraph (5)(a); and

(ii) B shall have a carer element included in their award of universal credit,

for that day in respect of that severely disabled person.”.

(4) In regulation 30 (meaning of “regular and substantial caring responsibilities for a severely disabled person”)—

(a) for paragraph (1) substitute—

“(1) For the purposes of Part 1 of the Act and these Regulations, a person has regular and substantial caring responsibilities for a severely disabled person if—

(a) they satisfy the conditions for entitlement to a carer’s allowance or would do so but for the fact that—

(i) their earnings have exceeded the limit prescribed for the purposes of that allowance; or

(ii) they are—

(aa) resident, or treated as resident, in Scotland; or

(bb) resident outside of Great Britain and have a genuine and sufficient link to Scotland; or

(b) they are entitled to carer support payment.”;

(b) in paragraph (2), for “paragraph (1)” substitute “paragraph (1)(a)”;

(c) after paragraph (3) insert—

“(4) For the purposes of paragraph (1), “sufficient” has the meaning given in paragraph 3 of Schedule 1 to the Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023.”.

Explanatory Note

(This note is not part of the Order)

The Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023 (S.S.I. 2023/302) introduce arrangements for the payment of carer’s assistance in the form of carer support payment. Carer support payment replaces carer’s allowance as the benefit paid to those in Scotland with eligible caring responsibilities for a disabled person.
