The Secretary of State makes this Order in exercise of the powers conferred by paragraph 8(1) of Part 2 of Schedule 8 and paragraph 3(1) of Schedule 10 to the Traffic Management Act 2004(1) (“the Act”).

Cambridgeshire County Council and West Sussex County Council have applied to the Secretary of State for an order to be made in exercise of those powers, in respect of parts of their respective areas.

The Secretary of State has consulted the chief officers of the Cambridgeshire Constabulary and Sussex Police, in accordance with the requirements of paragraph 8(3) of Part 2 of Schedule 8 and paragraph 3(4) of Schedule 10 to the Act.

Citation, commencement, extent and application

1.—(1) This Order may be cited as the Civil Enforcement of Parking Contraventions Designation (No. 2) (West Sussex) (Chichester and Crawley) (Amendment) and the Civil Enforcement of Parking Contraventions Designation Order 2023 and comes into force on 19th December 2023.

(2) This Order extends to England and Wales, but applies only in England.

Interpretation

2.  In this Order “grid reference” means Ordnance Survey National Grid reference point.

Designation of civil enforcement area and special enforcement area for Cambridgeshire

3.  The Secretary of State designates the part of the area of Cambridgeshire County Council specified in the Schedule as—

(a)a civil enforcement area for parking contraventions; and

(b)a special enforcement area.

Amendment of the Civil Enforcement of Parking Contraventions Designation (No. 2) (West Sussex) (Chichester and Crawley) Order 2010

4.—(1) The Civil Enforcement of Parking Contraventions Designation (No. 2) (West Sussex) (Chichester and Crawley) Order 2010(2) is amended as follows.

(2) In the Schedule (the part of the area of The West Sussex County Council designated as a civil enforcement area for parking contraventions and as a special enforcement area), in paragraph 1, for “except” substitute “, including the A27 Oving crossroads from the B2144 Oving Road (east) at Ordnance Survey National Grid reference SU8780404983, to the B2144 Oving Road (west) at Ordnance Survey National Grid reference SU8775004985, excepting the remainder of”.

SCHEDULEThe Part of the Area of Cambridgeshire County Council Designated as a Civil Enforcement Area for Parking Contraventions and Special Enforcement Area

1.  The District of South Cambridgeshire except—

(a)the A14 and its associated slip roads from the boundary with the District of Huntingdonshire at grid reference TL 31984 66982 to the boundary of Cambridge City at grid reference TL 47307 62022, and from the boundary of Cambridge City at grid reference TL 48188 61640 until the boundary of the District of East Cambridgeshire at grid reference TL 53796 59960;

(b)the A428 and its associated slip roads from its junction with the A14 at grid reference TL 41897 61299 (junction 31, Girton Interchange) to the boundary with the District of Huntingdonshire at grid reference TL 23933 60172;

(c)the A11 and its associated slip roads from its junction with the M11 at grid reference TL 50412 44214 (junction 9a, Stump Cross) to the boundary with the District of East Cambridgeshire at grid reference TL 57417 57623;

(d)the M11 and its associated slip roads from—

(i)the boundary with the County of Essex at grid reference TL 50154 42357 to the boundary with Cambridge City at grid reference TL 44126 53263 and to its junction with the A11 at grid reference TL 50412 44214;

(ii)the boundary with Cambridge City at grid reference TL 43855 53529 to the boundary of Cambridge City at grid reference TL 42003 58665; and

(iii)the boundary with Cambridge City at grid reference TL 42111 59769 to the junction with the A14 at grid reference TL 40638 62236 (junction 31, Girton Interchange); and

(e)the roads within the site known as Bassingbourn Barracks, located at Bassingbourn Barracks, Bassingbourn, Royston, SG8 5LX, that are not highways maintainable at public expense (within the meaning of section 329(1) of the Highways Act 1980(3)).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order designates parts of the area of Cambridgeshire County Council as a civil enforcement area for parking contraventions, and as a special enforcement area, for the purposes of Part 6 of the Traffic Management Act 2004 (c. 18).

This Order also amends the Civil Enforcement of Parking Contraventions Designation (No. 2) (West Sussex) (Chichester and Crawley) Order 2010 (S.I. 2010/689) to designate civil enforcement and special enforcement areas for parking contraventions on some of the roads that were previously excluded from the District of Chichester.

A full Impact Assessment has not been prepared for this instrument as no, or no significant impact, is foreseen on the private, public or voluntary sectors. An Explanatory Memorandum has been prepared for this Order and is available alongside this instrument on the UK Legislation website www.legislation.gov.uk.
