The Minister for the Cabinet Office makes these Regulations in exercise of the power conferred by Article 2 of Regulation (EC) No. 2195/2002 of the European Parliament and of the Council of 5th November 2002 on the Common Procurement Vocabulary (CPV)(1).

Citation and commencement

1.—(1) These Regulations may be cited as the Common Procurement Vocabulary (Amendment) Regulations 2023.

(2) These Regulations come into force on 29th June 2023.

Amendment to Regulation 2195/2002 of the European Parliament and of the Council

2.—(1) Regulation (EC) No. 2195/2002 of the European Parliament and of the Council of 5th November 2002 on the Common Procurement Vocabulary (CPV) is amended as follows.

(2) In Annex 1(2) (Common Procurement Vocabulary)—

(a)in the description for CPV code 85311200-4, for “the handicapped” substitute “disabled people”;

(b)in the description for CPV code 85312120-6, for “handicapped” substitute “disabled”.

(3) In Annex 2(3) (Correspondence table between CPV and CPC Prov.)—

(a)in the description for CPV code 85311200-4, for “the handicapped” substitute “disabled people”;

(b)in the description for CPV code 85312120-6, for “handicapped” substitute “disabled”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend Regulation (EC) No. 2195/2002 of the European Parliament and of the Council of 5th November 2002 on the Common Procurement Vocabulary (CPV) by changing references to “handicapped” in the Regulation to “disabled”, as the current wording in the UK’s Common Procurement Vocabulary codes is not in line with the language of the Equality Act 2010.

A full impact assessment has not been published for this instrument as it has minimal impact on business, charities, voluntary bodies or the public sector.

OJ No. L 340, 16.12.2002, p.1. Article 2 has been amended by paragraph 4.1 of the Annex to Regulation (EC) No. 596/2009 (OJ No. L 188, 18.7.2009, p.14) and regulation 18 of S.I. 2020/1319. Regulation 18 has vested the power to amend the Annexes to Regulation (EC) No. 2195/2002 in the Minister for the Cabinet Office.
