The Pencoed College (Dissolution) Order 2000
Coming into force
1st April 2000
The National Assembly for Wales (“the National Assembly”) has received a proposal from the Further Education Funding Council for Wales, made in accordance with section 51 of the Further and Higher Education Act 1992() (“the Act”), for the dissolution under section 27 of the Act of the further education corporation known as Pencoed College() (“the Transferor”);
In exercise of the power conferred on the Secretary of State by section 27 of the Act and now vested in the National Assembly(), the National Assembly after consulting the Transferor and with the consent of the further education corporation known as Bridgend College of Technology() (“the Transferee”) makes the following Order:
1. This Order may be cited as The Pencoed College (Dissolution) Order 2000 and shall come into force on 1st April 2000.
2. On 1st April 2000 the Transferor shall be dissolved and all of its property, rights and liabilities shall be transferred to the Transferee, being a body corporate established for purposes which include the provision of educational facilities or services.
3. Section 26(2), (3) and (4) of the Act shall apply to any person employed by the Transferor immediately before 1st April 2000 as if the references in that section —
(a)to a person to whom that section applies were to a person so employed;
(b)to the operative date were to 1st April 2000;
(c)to the transferor were to the Transferor; and
(d)to the corporation were to the Transferee.

Explanatory Note
This Order dissolves the further education corporation established to conduct Pencoed College. It provides for its property, rights and liabilities to transfer to Bridgend College of Technology Further Education Corporation and secures the rights of its employees by applying section 26(2) to (4) of the Further and Higher Education Act 1992.
