The National Assembly for Wales, in exercise of the powers conferred on the Secretary of State for Wales by section 9(1) and (8) of the National Health Service and Community Care Act 1990(1) and of all other powers enabling the Secretary of State in that behalf, and now vested in the National Assembly for Wales(2), with the consent of the Treasury(3), hereby makes the following Order:
1990 c. 19. Section 9(1) was amended by section 15 of the Health Act 1999 (c. 8).
The functions of the Secretary of State under section 9(1) of the National Health Service and Community Care Act 1990 (“the 1990 Act”) were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (SI 1999/672) (“the Transfer of Functions Order”).
See section 9(8) of the 1990 Act. The Treasury consent requirement has been specifically preserved by Schedule 1 to the Transfer of Functions Order.
