Mae newidiadau yn dal heb eu gwneud i Rheoliadau Organeddau A Addaswyd Yn Enetig (Eu Gollwng Yn Fwriadol) (Cymru) 2002. Mae unrhyw newidiadau sydd wedi cael eu gwneud yn barod gan y tîm yn ymddangos yn y cynnwys a chyfeirir atynt gydag anodiadau.
Nid yw newidiadau ac effeithiau sydd eto i'w gwneud gan y tîm golygyddol ond yn berthnasol wrth edrych ar y fersiwn ddiweddaraf neu fersiwn ragolygol o ddeddfwriaeth. Felly, nid oes modd eu gweld wrth edrych ar ddeddfwriaeth fel y mae ar bwynt penodol mewn amser. Er mwyn gweld yr wybodaeth 'Newidiadau i Ddeddfwriaeth' ar gyfer y ddarpariaeth hon ewch yn ôl i'r fersiwn ddiweddaraf gan ddefnyddio'r opsiynau yn y blwch 'Pa Fersiwn' uchod.
4.—(1) Mae diwygiadau adran 106 o'r Ddeddf (diben Rhan VI o'r Ddeddf ac ystyr “genetically modified organisms” ayb), a wnaed gan Reoliadau Organeddau a Addaswyd yn Enetig (Eu Gollwng yn Fwriadol) 2002 yn effeithiol mewn perthynas â Chymru fel a ganlyn:
(2) Mae'r diwygiad a wnaed gan reoliad 3(2) o'r Rheoliadau hynny sy'n rhoi'r canlynol yn lle is-adran (1)—
“(1) This Part has effect for the purpose of ensuring that all appropriate measures are taken to avoid damage to the environment which may arise from the escape or release from human control of genetically modified organisms.”,
yn effeithiol hefyd yng Nghymru.
(3) Mae diwygiad is-adran (4) a wnaed gan reoliad 3(3) o'r Rheoliadau hynny, sy'n rhoi'r canlynol yn lle paragraff (a) —
“(a)have been artificially modified, or”,
yn effeithiol hefyd mewn perthynas â Chymru.
(4) Mae'r diwygiad a wnaed gan reoliad 3(4) o'r Rheoliadau hynny (sy'n mewnosod is-adrannau (4A) i (4D)) yn cael ei addasu gan baragraff (5) ac, o'i addasu felly, mae'n effeithiol hefyd mewn perthynas â Chymru.
(5) Yn is-adran (4D), fel y'i mewnosodwyd gan y rheoliad hwnnw, ar ôl “Secretary of State” mewnosodwch— “or, in relation to Wales, the National Assembly for Wales”.
(6) Mae testun is-adrannau (4A) i (4D), o'i fewnosod gan y rheoliad hwnnw a'i addasu gan baragraff (5), fel a ganlyn—
“(4A) Genes or other genetic material in an organism are “artificially modified” for the purposes of subsection (4) above if they are altered otherwise than by a process which occurs naturally in mating or natural recombination.
This subsection is subject to subsections (4B) and (4C) below.
(4B) For the purposes of subsection (4) above—
(a)genes or other genetic material shall be taken to be artificially modified if they are altered using such techniques as may be prescribed for the purposes of this paragraph;
(b)genes or other genetic material shall not be regarded as artificially modified by reason only of being altered by the use of such techniques as may be prescribed for the purposes of this paragraph.
(4C) An organism shall be taken not to be a genetically modified organism for the purposes of this Part if it is an organism of a prescribed description.
(4D) In subsections (4B) and (4C) above “prescribed” means prescribed by regulations made by the Secretary of State, or, in relation to Wales, the National Assembly for Wales.”.
(7) Mae'r diwygiad a wnaed gan reoliad 3(5) o'r Rheoliadau hynny (sy'n hepgor is-adrannau (5) a (6)) yn effeithiol hefyd mewn perthynas â Chymru.
