The National Assembly for Wales, there being no persons with whom it appeared to it that consultation would be desirable, makes the following Regulations in exercise of the powers conferred on the Secretary of State by sections 408 and 569(4) and (5) of the Education Act 1996(1) and now vested in the National Assembly for Wales(2).

Name and commencement

1.  These Regulations are called the Education (Individual Pupils' Achievements) (Information) (Wales) (Amendment) Regulations 2002 and come into force on 4th February 2002.

Amendment of Regulations

2.—(1) The Education (Individual Pupils' Achievements) (Information) (Wales) Regulations 1997(3) are amended as follows.

(2) In regulation 2(1), for the definitions of “NC tests” (in both places) and “NC tasks” substitute—

  • “NC tests” and “NC tasks” mean, respectively, National Curriculum tests and National Curriculum tasks administered to pupils in accordance with the statutory arrangements;.

(3) In regulation 3(11) omit “first”.

(4) In regulation 7(2)(a)(ii) omit “grant-maintained school, a grant-maintained special school or a”.

(5) In Schedule 1, for sub-paragraph (2) of paragraph 1 substitute—

  • The results of teacher assessment of the pupil’s level in the attainment targets in English entitled ‘Speaking and Listening', ‘Reading' and ‘Writing', and in the attainment targets in Welsh entitled ‘Oral (Speaking, Viewing and Listening)', ‘Reading' and ‘Writing'..

(6) In Schedule 2, in sub-paragraph (2) of paragraph 1 omit the words from “and by NC tests” to the end of that sub-paragraph, and omit the whole of sub-paragraph (5) of that paragraph.

(7) In Schedule 3, in sub-paragraph (1) of paragraph 1 for “Welsh Office” substitute “National Assembly for Wales”.

(8) In Schedule 3, in sub-paragraph (2) of paragraph 1 for “shown (in every case) both as determined by teacher assessment and by NC tests”, substitute “as determined by teacher assessment”, and omit sub-paragraph (5) of that paragraph.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Education (Individual Pupils' Achievements) (Information) (Wales) Regulations 1997 so as to remove provisions relating to tests known as “standard task assessments” — see regulation 2(1) — (3), (5) — (6) and (8). Those tests used to be administered to 7 year old pupils at the end of Key Stage 1 of the National Curriculum, but were abolished with effect from 2002 — see the Education (National Curriculum) (Assessment Arrangements for English, Welsh, Mathematics and Science) (Key Stage 1) (Wales) Order 2002 (S.I. 2002/45 (W.4)). They also remove a reference to grant-maintained and grant-maintained special schools (which no longer exist) and substitute for a reference to “the Welsh Office” a reference to “the National Assembly for Wales” — see regulations 2(4) and (7).
