Y sefyllfa ariannol
28.—(1) Rhaid i'r darparydd cofrestredig:
(a)rhedeg yr asiantaeth mewn modd sy'n debyg o sicrhau y bydd yn hyfyw yn ariannol er mwyn cyflawni'r nodau a'r amcanion a nodir yn ei datganiad o ddiben; a
(b)sicrhau bod cyfrifon digonol yn cael eu cynnal a chadw'n gyfoes ynglyn â'r asiantaeth.
(2) Os bydd yr awdurdod cofrestru yn gofyn amdanynt, rhaid i'r darparydd cofrestredig ddarparu i'r awdurdod cofrestru unrhyw wybodaeth a dogfennau y bydd yn ofynnol i'r awdurdod eu cael er mwyn ystyried hyfywedd ariannol yr asiantaeth, gan gynnwys —
(a)cyfrifon blynyddol yr asiantaeth wedi'u hardystio gan gyfrifydd;
(b)geirda oddi wrth fanc yn mynegi barn ar statws ariannol y darparydd cofrestredig;
(c)gwybodaeth am ddull ariannu'r asiantaeth a'i hadnoddau ariannol;
(ch)gwybodaeth am unrhyw gwmnïau cysylltiedig y corff; a
(d)tystysgrif yswiriant ar gyfer y darparydd cofrestredig o ran unrhyw rwymedigaeth y gallai'r darparydd fynd iddi mewn cysylltiad â'r asiantaeth o ran marwolaeth, anaf, atebolrwydd cyhoeddus, difrod neu unrhyw golled arall.
