Cynnal yr achos a thystion
18.—(1) Yn ddarostyngedig i is-baragraffau (2) a (3), mae unrhyw berson—
(a)ar ôl cael ei (g)wysio yn unol â rheolau llysoedd sirol fel tyst yn y broses gymrodeddu sy'n gwrthod neu sy'n esgeuluso, heb reswm digonol, ymddangos neu gyflwyno unrhyw ddogfennau y mae'r wys yn mynnu eu bod yn cael eu cyflwyno; neu
(b)ar ôl cael ei (g)wysio felly neu ar ôl bod yn bresennol y broses gymrodeddu neu ar ôl cael ei (g)alw i roi tystiolaeth, sy'n gwrthod tyngu llw neu roi tystiolaeth,
yn fforffedu'r cyfryw ddirwy ag y gall barnwr y llys sirol ei nodi.
(2) Ni chaiff barnwr gyfarwyddo o dan is-baragraff (1) fod person yn fforffedu dirwy o fwy na £400.
(3) Ni fydd unrhyw berson a wysir yn unol â rheolau llysoedd sirol fel tyst yn y broses gymrodeddu yn fforffedu dirwy o dan y paragraff hwn oni thalwyd neu oni chynigiwyd iddo neu iddi pan gyflwynwyd y wps y cyfryw swm rhesymol o ran ei dreuliau/threuliau ag y gall y cymrodeddwr ei nodi (gan gynnwys, mewn achosion priodol, iawndal am golli amser), o ystyried y cyfryw symiau sy'n daladwy yn y cyfryw achosion ag y gellir eu pennu at ddibenion adran 55 Deddf Llysoedd Sirol 1984(1).
(4) Caiff barnwr y llys sirol yn ôl ei d(d)isgresiwn gyfarwyddo y gellir defnyddio unrhyw gyfryw ddirwy yn gyfan gwbl neu unrhyw ran ohoni, ar ôl tynnu costau, i ddigolledu parti a niweidiwyd gan y gwrthodiad neu'r esgeulustod.
